Equality and Justice
This book represents the effort by jurists from all walks of life – legal practitioners, scholars, judges, legal advisers to NGOs, and equality bodies – to reflect on the challenges that sexual orientation and gender identity pose to contemporary law. It originates from the international conference Equality and Justice - LGBTI (Lesbian, Gay, Bisexual, Trans and Intersex) Rights in the XXI Century organized within the framework of the Equal-Jus.eu Project in Florence on May 12 and 13, 2011.
It discusses the state of legal studies in the field of sexual orientation and gender identity and deals more specifically with the notions and usage of sex and gender in the Western legal tradition, with constitutional and comparative law approaches, EU and migration law, and issues common to LGBTI couples such as freedom of movement, mutual recognition, parenthood, and inheritance. Significant attention is devoted to gender identity issues and to the role of the judiciary and of equality bodies in dealing with LGBTI cases. Essays are written in English, Italian and French.
Il volume contiene le riflessioni di accademici, magistrati e organismi di uguaglianza sulle sfide che l’orientamento sessuale e l'identità di genere pongono al diritto contemporaneo. Nato dalla conferenza ‘Eguaglianza e giustizia. I diritti delle persone LGBTI (lesbiche, gay, bisessuali, trans e intersessuate) nel XXI secolo’ tenutasi a Firenze nel maggio 2011, il testo affronta, in particolare, questioni che riguardano le coppie LGBTI come la libertà di movimento, il mutuo riconoscimento, la genitorialità e le successioni. Comprende contributi in inglese, italiano e francese.

Alexander Schuster
Alexander Schuster holds a dual doctorate from Trento University and from Strasbourg University with a thesis on gender-neutral family institutions. He is a post-doc researcher at the University of Udine, where he acts as European coordinator of the EU co-funded project Equal-Jus.eu, and is a lecturer in law at the University of Trento. He is an Italian barrister as well as an independent legal expert of the EU Commission – DG Justice. He has taught and researched at several universities and scientific institutions in Europe and North America. His academic interests include fundamental rights, EU law, non-discrimination law and the new legal challenges posed by bioethical and technological research. He is the editor of a book on same-gender parenthood (Omogenitorialità, Milano 2011) and co-editor of a multidisciplinary research project for the Italian Government on LGBT discrimination in Italy (DisOrientamenti, Rome 2011).
